Terms of Service

Please read these Terms of Service ("Terms") carefully before using pixelcolorwars.com (the "Site") operated by Pixel Color Wars ("we", "our", "us"). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 13 years old (16 in the EEA) to use the Site. By registering an account you confirm that you meet the minimum age requirement for your jurisdiction. If you are under 18, you confirm that you have your parent or guardian's permission. We reserve the right to close accounts where we have reasonable grounds to believe the minimum age requirement has not been met.

2. Accounts

You may play as a guest without creating an account. If you register, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Use a username that is not offensive, impersonating, or deceptive
  • Notify us immediately if you suspect unauthorised access to your account

We reserve the right to terminate or suspend accounts that violate these Terms, at our sole discretion and without prior notice.

3. Game Modes and Advertising Consent

The Site offers two game modes:

  • Local vs AI — runs entirely in your browser with no server connection. Available to all visitors at no cost and with no advertising consent required. No advertising is displayed in this mode.
  • Online Multiplayer — connects to our shared real-time server. This mode is provided free of charge and is funded entirely by advertising revenue. To access online multiplayer you must either:
    • Accept advertising cookies by clicking "Got it!" on the consent banner or "Accept Ads & Play Online" on the online mode gate; or
    • Purchase ad-free access from the in-game Shop, which grants online multiplayer access without requiring ad consent.

You may withdraw your advertising consent at any time via the cookie settings button accessible on every page. Withdrawal will remove your access to online multiplayer until consent is re-granted or ad-free access is purchased. Local vs AI mode remains available at all times regardless of your consent choice.

4. Acceptable Use

You agree not to:

  • Use bots, scripts, automation tools, or any means to gain an unfair advantage in the game
  • Exploit bugs, glitches, or unintended game mechanics (report them to us instead)
  • Attempt to reverse-engineer, decompile, or tamper with the game server or protocol
  • Flood or intentionally degrade the service with excessive connections or requests
  • Harass other players or use the game as a vehicle for hate speech or abusive content
  • Circumvent or interfere with security features, authentication, or rate limits
  • Use the Site to transmit malware, spam, or unauthorised advertising

Violations may result in immediate account termination and, where applicable, legal action.

5. Virtual Items and In-Game Currency

The Site offers virtual in-game currency ("Coins") and virtual items (shields, power-ups, ad-free access). You acknowledge that:

  • Coins and virtual items have no real-world monetary value and cannot be exchanged for cash
  • All virtual items remain the property of Pixel Color Wars and are licensed to you for use within the game only
  • We may modify, suspend, or discontinue virtual items at any time without liability
  • Purchased Coins and ad-free access are final and non-refundable except as required by applicable law (see Section 6)
  • Earned Coins (through gameplay) are session-based and are not persisted between sessions for guest users; registered users' coin balances may be reset when the game round resets or your account is deleted
  • Shields earned through gameplay reset at round start; purchased shields are not refundable

6. Payments

Optional purchases (Coin packs, ad-free access) are processed by Stripe, Inc. Your payment information is collected and stored directly by Stripe; we do not store card details. All purchases are subject to Stripe's terms and your card issuer's terms.

Refunds may be requested within 14 days of purchase for EEA/UK consumers under applicable consumer protection law, or if the purchased item was not delivered due to a technical error on our part. Contact us at support@pixelcolorwars.com to request a refund.

7. Advertising

The Site displays third-party advertisements served by Google AdSense when you have granted advertising consent and have not purchased ad-free access. We do not control the content of individual advertisements. Ad-free access is available for purchase in the in-game Shop. See our Privacy Policy for full details of how advertising cookies work, how consent is managed, and your opt-out rights.

8. Intellectual Property

All content on the Site — including game code, graphics, sounds, tribe names, and lore — is owned by or licensed to Pixel Color Wars. You are granted a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from any part of the Site without our written permission.

The shared game map (pixel territory state) is generated collectively by all players. You grant us a royalty-free licence to display and transmit your in-game activity as part of the shared map.

9. Disclaimers and Limitation of Liability

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted availability, or error-free operation. We do not guarantee that the game will be available at any particular time or that game data (including virtual items, stats, and badges) will be preserved indefinitely.

To the maximum extent permitted by law, Pixel Color Wars shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, including loss of virtual items, coins, or account data.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, with or without notice. You may delete your account at any time by contacting us at support@pixelcolorwars.com. Upon termination, your right to use the Site ceases immediately and your account data will be deleted in accordance with our Privacy Policy.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States of America, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of the Commonwealth of Kentucky, United States of America.

If you are an EEA or UK consumer, you also benefit from any mandatory consumer protection provisions of your country of residence that cannot be overridden by contract, and you may bring proceedings in the courts of your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. The "Effective date" at the top of this page reflects the most recent revision. For terms that affect processing based on your consent (such as the advertising and online mode conditions in Section 3), material changes will require us to seek fresh consent — we will not rely on continued use of the Site as implied re-consent. For all other terms, continued use of the Site after changes are posted constitutes acceptance of the updated Terms. Material changes will be communicated via an in-game notice where reasonably practicable.
